1. Introduction

This Privacy Policy describes how MIR09 LLC (“MIR09”, “Company”, “we”, “our”, or “us”) collects, uses, discloses, retains, and protects personal information in connection with the digital memorial platform available at www.rip.gd (the “Platform” or “Service”).

This Policy should be read together with our Terms & Conditions, Public Offer, Data Deletion Policy, Cookie Policy, and, where applicable, the DNA Preservation Agreement.

Privacy rights and obligations may vary depending on your location and applicable law.

2. Information We Collect

2.1 Information You Provide

• Account Information: Name, email address, account credentials, and authentication information provided through supported sign-in providers such as Google and Facebook. These providers may share information with us in accordance with your authorization and their own privacy policies.
• Memorial Information: Names, dates, photographs, biographies, family relationships, memorial text, and other information submitted concerning deceased persons or other individuals.
• Document Archives: Files, photographs, and other documents uploaded for Legacy and Infinity plans.
• Payment and Wallet Information: Transaction records, payment status, wallet activity, and related billing information. Payment credentials may be processed directly by third-party payment providers such as PayPal rather than stored by MIR09.
• Communications: Messages, comments, support requests, and contact-form submissions.
• Digital Testament Information: Trusted-contact information and inactivity-related settings you provide for the Digital Testament feature.
• Memorial and Service Settings: Memorial dates, favorite memorials, schedule settings, email reminder preferences, and other settings or preferences used to operate and personalize Platform features.
• DNA-Related Information: Administrative information needed to arrange and manage DNA preservation. Physical biological samples are handled through a qualified third-party partner laboratory under the separate DNA Preservation Agreement.

2.2 Information Collected Automatically

• Usage and Device Data: IP address, browser type, operating system, device information, approximate location derived from IP address, pages viewed, and interaction information.
• Cookies and Similar Technologies: Session information, authentication status, preferences, security information, and other data collected through cookies or similar technologies. See our Cookie Policy.
• Technical Logs: Information reasonably necessary for security, troubleshooting, fraud prevention, service operation, and performance monitoring.
• Analytics: Where analytics tools are enabled, information about visits and interactions to understand and improve Platform performance.

3. How We Use Information

• Provide, maintain, moderate, and display memorials.
• Create and manage accounts and authentication.
• Process payments, wallet transactions, refunds, and accounting records.
• Provide support and respond to communications.
• Maintain and display memorial dates and related memorial information.
• Save and manage favorites and user-selected preferences.
• Manage schedules and settings for automated Platform features.
• Send email reminders based on user-selected dates, schedules, and preferences.
• Send automated service notifications related to account activity, memorials, scheduled events, security, billing, Digital Testament features, and Platform functionality.
• Administer Digital Testament settings as a technical Platform feature. The Digital Testament does not create or transfer legal inheritance rights.
• Facilitate DNA preservation administration, including coordination with the qualified third-party partner laboratory.
• Protect the Platform, prevent fraud and abuse, enforce our agreements, and improve service functionality.
• Comply with applicable laws, legal processes, and lawful governmental requests.

4. Legal Bases and Processing Grounds

Depending on the circumstances and your location, we may process personal information because it is necessary to provide the Service or perform a contract with you, because you have provided consent, because processing is necessary for legitimate business interests such as security and service improvement, or because processing is necessary to comply with a legal obligation. Where applicable law provides additional requirements or rights, we will follow that law.

5. Data Sharing and Disclosure

We do not sell personal information. We may disclose information when reasonably necessary to:

• Payment Providers: Process purchases, wallet funding, refunds, and payment-related security checks.
• Infrastructure and Technology Providers: Provide hosting, cloud storage, databases, security, authentication, backups, email, and other essential services.
• Authentication Providers: Support Google and Facebook sign-in when you choose those services.
• Analytics and Performance Providers: Understand Platform usage and improve performance where such services are enabled.
• DNA Service Providers: A qualified third-party partner laboratory or related provider where you purchase or use DNA preservation. Physical DNA handling is governed by the DNA Preservation Agreement.
• Legal and Regulatory Authorities: Where required by law, court order, legal process, or governmental request, or reasonably necessary to protect rights, safety, security, or the Platform.
• Business Transfers: In connection with a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, subject to applicable law.

Service providers processing information on our behalf are expected to use it only for authorized purposes and in accordance with applicable law and contractual arrangements.

6. Public Memorial Information

Information you intentionally publish as part of a public memorial may be visible to other users and the public. You should not publish highly sensitive personal information about living individuals unless you have an appropriate legal basis or authorization.

Memorial information about deceased persons may contain personal information about living relatives or other individuals. You are responsible for respecting applicable privacy and other rights when submitting content.

7. Data Security

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, disclosure, or destruction. Depending on the information and Platform function, safeguards may include:

• SSL/TLS encryption for data transmitted between your device and the Platform.
• Access controls and authentication mechanisms.
• Protection of account credentials and sensitive information using appropriate security measures.
• Administrative controls limiting access to authorized personnel and service providers.
• Backups and operational safeguards designed to support service availability and recovery.
• Monitoring and security measures intended to detect and prevent unauthorized activity.

No method of transmission or storage can be guaranteed to be completely secure, and we cannot guarantee absolute security.

8. Your Privacy Rights

Depending on your jurisdiction, you may have rights concerning your personal information, including:

• Access: Request information about personal information we maintain about you.
• Correction: Request correction of inaccurate or incomplete information.
• Deletion: Request deletion, subject to applicable legal and operational exceptions.
• Portability: Request a copy of certain information in a usable format where required by law.
• Restriction or Objection: Where applicable, restrict or object to certain processing.
• Withdrawal of Consent: Where processing is based on consent, withdraw consent as permitted by law.
• Other Statutory Rights: Depending on location, additional rights may apply to sensitive information, sale or sharing, profiling, or appeals.

These rights are subject to exceptions and limitations under applicable law.

9. California Privacy Rights

If you are a California resident and the California Consumer Privacy Act (“CCPA”), as amended, applies to MIR09, you may have rights including the right to know about personal information collected, used, or disclosed; request deletion or correction; opt out of sale or sharing where applicable; limit certain uses and disclosures of sensitive personal information; and receive non-discrimination for exercising applicable rights.

MIR09 does not sell personal information. If our practices ever constitute “sale” or “sharing” under applicable California law, we will provide the notices and opt-out mechanisms required by law.

California privacy requests may be submitted through our Contact Form. We may take reasonable steps to verify identity before completing a request.

10. Data Retention

We retain information only for as long as reasonably necessary for the purposes described in this Policy, the selected service plan, our agreements, and applicable law.

• Basic Plan: Memorial preservation is intended for 10 years, subject to the Public Offer and applicable policies.
• Legacy Plan: Memorial preservation is intended for 100 years, subject to the Public Offer and applicable policies.
• Infinity Plan: “Permanent” means indefinite preservation without a scheduled expiration date, for as long as the Platform continues to operate and subject to the Public Offer, Terms & Conditions, applicable law, and the selected service terms.
• Account and Transaction Records: Certain records may be retained after account closure for accounting, tax, fraud prevention, security, dispute resolution, legal compliance, or legal claims.
• Deleted Memorials: When deletion is initiated, the memorial may enter a 180-day retention period during which it is not publicly accessible. After that period, information we are not legally required or otherwise permitted to retain will be deleted under the Data Deletion Policy.
• DNA Samples: Physical DNA samples are governed by the separate DNA Preservation Agreement and applicable laboratory procedures.

11. Data Deletion

You may request account closure or deletion of applicable personal information through the Platform or our Contact Form. Deletion is subject to the procedures and exceptions described in our Data Deletion Policy.

Account closure does not necessarily result in immediate deletion of every record. Information may be retained where necessary or permitted for legal compliance, accounting, security, fraud prevention, dispute resolution, backups, or legal claims.

Physical DNA samples are handled separately under the DNA Preservation Agreement and are not automatically destroyed merely because an ordinary digital account record is deleted.

12. Digital Testament and Trusted Contacts

The Digital Testament is a technical Platform feature. A designated trusted contact may receive access or administrative control over specified Platform features according to the settings established by the account holder and applicable procedures after the relevant inactivity conditions are satisfied.

The Digital Testament does not transfer ownership of property, money, biological material, or other assets, and is not a legally binding Last Will and Testament, estate plan, or testamentary instrument. The Platform does not determine legal heirs or provide estate-planning advice.

13. Children's Privacy & Safety Standards

The Service is not intended for children under 18. We do not knowingly collect personal information directly from children under 13. If you believe a child has provided personal information without appropriate authorization, please contact us so that we can review the situation.

Child Sexual Abuse Material (CSAM) and Exploitation Policy: MIR09 strictly prohibits any Child Sexual Abuse Material (CSAM) or child exploitation content on the Platform. We maintain a zero-tolerance policy for child abuse or sexual exploitation. Users may report any policy violations, harmful content, or child safety concerns at any time via our Contact Form or by emailing us directly. Any reported content or accounts violating these safety standards will be immediately removed and reported to appropriate law enforcement and regulatory authorities, including NCMEC.

14. International Data Transfers

Because MIR09 and its service providers may operate in different jurisdictions, personal information may be processed or stored outside your state or country of residence. Where applicable law requires safeguards for international transfers, we will use legally recognized mechanisms or other appropriate safeguards.

Third-party providers may have their own privacy practices and terms. We encourage users to review the policies of providers they choose for authentication, payment, communications, or other third-party services.

15. Cookies and Similar Technologies

The Platform may use cookies and similar technologies for authentication, security, session management, preferences, analytics, and other operational purposes. See our Cookie Policy for details and available controls.

16. Third-Party Services and Links

The Platform may integrate with or link to third-party services, including Google, Facebook, PayPal, hosting providers, analytics services, and the qualified third-party partner laboratory used for DNA preservation. We do not control the privacy practices of independent third parties. Their collection and use of information may be governed by their own privacy policies and terms.

17. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in the Platform, our data practices, service providers, or applicable legal requirements. The current version will be posted on the Platform with its updated date.

Where required by applicable law, we will provide additional notice or obtain consent for material changes.
